The importance of hiring authorized workers in 2025

Employment regulations at the state, local, and federal level are subject to constant change. However, in recent years, this field has become even more unpredictable due to the changing economic landscape and recent presidential administration changes about worker regulations.

A big focus lately in the employment space as well as national news has been hiring authorized workers. Here’s a quick primer on what you need to know for your operation.

What are the regulations?

The Immigration Reform and Control Act of 1986 requires all U.S. employers, regardless of size, to complete a Form I-9 upon hiring a new employee to work in the United States.

The federal government uses E-Verify to enhance enforcement of federal immigration law. E-Verify is mandatory for federal contractors with contracts containing the Federal Acquisition Regulation (FAR) E-Verify clause, and some states require the use of E-Verify for employers.

In Action

No changes have been made to the E-Verify system itself, but enforcement and other protective measures have increased.

To ensure compliance with all ICE standards and procedures, your organization needs to choose a staffing partner who is part of the ICE Mutual Agreement between Government and Employers (IMAGE) program.

Staff Management | SMX became a charter member of IMAGE program when it was founded in 2006. With over a decade of leadership in IMAGE, we continue to incorporate compliance best practices into daily operations – including within Stafftrack, our proprietary technology platform.

What to Expect in 2025

Immigration has entered the national conversation in a big way already this year. Many new policies may be battled in the courts but expect an uptick in enforcement of previously established policies.

It’s important to review your compliance process now and ensure you have the proper policies and documentation in place.
